Trinity Trustee Seeks Judgment Compelling Defendants to Deliver the Debtor Records & Missing Funds

November 10, 2021, Eastern District of California – Trustee Kimberly J. Husted for Debtor Trinity River Construction, Inc.’s bankruptcy estate brings a lawsuit against Defendants Ronald Jurin and Wendy Jurin. The Trustee requests the Court to compel the Defendants to provide access to Trinity’s records and missing information and to avoid transfers worth $1,040,061.89 together with accrued interest as alleged fraudulent conveyances.

Specifically, the complaint asserts that the Defendants allegedly controlled the Debtor’s financial accounts and credit transactions and allegedly possessed Trinity’s records and missing funds. The Trustee alleges that the Debtor’s records and missing funds are of significant value to the estate and because the Defendants did not respond to the Trustee’s requests for access to the Debtor’s books and financial statements, the Trustee is entitled to a judgment compelling Defendants to account for and deliver the Debtor records, missing funds, and their proceeds to the Trustee. The Trustee also seeks judgment awarding compensatory civil sanctions against the Defendants for their willful violation of the automatic stay until the Debtor records and missing funds are returned to the Trustee.
