Twenty-Seven Defendants Face Bankruptcy Claw Back Actions in the Sklar Exploration Company Bankruptcy Case

March 24, 2022, Colorado – Thomas M. Kim, the creditor trustee for the post-confirmation trustee of the Debtors Sklar Exploration Company, LLC, et al., has filed twenty-seven (27) adversary actions seeking to avoid and recover alleged preferential transfers pursuant to Section 547 of the Bankruptcy Code. As gathered from the Plaintiff’s complaints, the Debtors were an independent oil and gas exploration and production company.

The range of claims in these cases is between $22,000 and $$530,125.30. The top claims in the group are filed against Capstar Drilling, L.P. (AP No. 22-01077), Brothers Contractors, Inc. (AP. No. 22-01088), and Quality Drilling Fluids, Inc (AP No. 22-01073) for amounts $530,125.30, $511,758.60 and $295,877.70 respectively.

The Debtors’ bankruptcy cases are filed in the Bankruptcy Court for the District of Colorado. Lead Bankruptcy Case No. is 20-12377. The Law firm of Diamond McCarthy LLP is representing as the counsel for the Plaintiff. Bankruptcy Judge Elizabeth E. Brown is presiding over these cases.
