Trustee James A. Overcash Sues Rojana Enterprises To Recover Alleged Fraudulent Transfer of Real Property in Pinnacle Regional Hospital’s Bankruptcy Case
June 18, 2021, District of Kansas – Plaintiff James A. Overcash, as a Chapter 7 Trustee of Rojana Realty Investments, Inc. sues Rojana Enterprises, Inc. (“REI”) to avoid and recover fraudulent transfers of real property pursuant to sections 502, 548 and 550 of the Bankruptcy Code in the bankruptcy case of Pinnacle Regional Hospital, Inc. et al. (“Debtors”). The Debtors filed voluntary petitions for relief last year in February 2020.
By way of background, Rojana was the owner of property located in Johnson County, Kansas. Allegedly, Rojana transferred certain properties to REI and did not receive consideration in exchange for the transfers. The complaint alleges that the transfer of property was made within two years of the petition date and that Rojana was insolvent or was rendered insolvent by the said transfers of property. According to the complaint, at the time of transfer, Rojana’s assets were purportedly worth significantly less than Rojana’s liabilities.
The case is In re Pinnacle Regional Hospital, Inc. et al., A.P. Number : 21-06021 in the United States Bankruptcy Court for District of Kansas. The Trustee is represented by Stinson LLP and Honorable Bankruptcy Judge Dale L. Somers is overseeing the Debtor’s bankruptcy case.
