Senior Care Centers Trustee Seeks $1.9M From SDB Capital Holdings in Alleged Fraudulent Transfers

December 20, 2021, Northern District of Texas Alan D. Halperin, as an unsecured creditor trustee for Senior Care Centers, LLC, et al., files a complaint against SDB Capital Holdings, LLC and its manager, Susan D. Boerner, to recover alleged fraudulent transfers under Sec. 548 of the Bankruptcy Code. The Trustee accuses SDB of allegedly receiving a fraudulent transfer either from Boerner or from B&C Investments, LLC, through Boerner.

Halperin argues that SDB allegedly benefitted from unscrupulous conduct by Granite Investment Group, which dominated the affairs of Senior Care Centers. Specifically, Halperin argues that Granite allegedly caused Senior Care Centers to pay $1,090,136.99 in satisfaction of Granite’s debt to B&C under a certain promissory note. Adding further, the complaint argues that Boerner allegedly caused B&C to transfer that amount to her personal bank account, which she eventually transferred to SDB.

The complaint also contends that SDB was allegedly established to shield assets from Boerner’s creditors, and at the time of the alleged transfer, Boerner was not indebted to SDB and did not provide any value in exchange for the said transfer to either B&C, Senior Care Centers or Boerner. Accordingly, Halperin seeks to avoid $1,090,136.99 as an alleged fraudulent conveyance under Sec. 548 of the Bankruptcy Code.
