Giuliano Sues to Recover Amounts Allegedly Owed for Use of Art Van Trademarks

May 9, 2022, Delaware – Alfred T. Giuliano, the chapter 7 trustee of the Debtors Start Man Furniture, LLC et al., formerly known as Art Van Furniture, LLC, brought a complaint against Simpson Furniture Company for turnover of amounts allegedly owed to the debtors under a franchise agreement.

Giuliano contends that pursuant to the agreement, Simpson was required to pay certain royalties and other fees to the Debtors for use of debtors’ trademarks which allegedly remained owed to the debtors as of the filing of the complaint.

By way of this complaint, Guiliano seeks to recover $797,958.95 in royalties and fees alleging a claim for breach of contract, turnover of property and attorney’s fees and costs, and foreclosure of security interests under Uniform Commercial Code, among other declaratory reliefs.

The Debtors filed for bankruptcy on March 8, 2020, by filing voluntary chapter 11 bankruptcy petitions in the Bankruptcy Court for the District of Delaware.
