Clawback Lawsuits Commence in The New School of Cooking, Inc., Trustee Avery Files 14 Lawsuits

January 14, 2022, Central District of California – Wesley H. Avery, in his capacity as Chapter 7 Trustee for the bankruptcy estate of The New School of Cooking, Inc., initiates fourteen clawback actions against several defendants to recover alleged preference and fraudulent transfers of property under Sections 547 and 548 of the Bankruptcy Code.

Asian Culinary Institute, LLC, CEC Educational Services, LLC, J.P. Morgan Chase Bank, N.A., Technology Investment Partners, LLC, Walnut USA, Inc., Wells Fargo Bank are some of the creditors against whom Avery has filed lawsuits. 

The Debtor operated a cooking school. Two years ago, on January 15, 2020, the Debtor filed a voluntary petition for relief under chapter 11 of the Bankruptcy Code. Honorable Judge Neil W. Bason is presiding over the Debtor’s bankruptcy cases. The law firm of Lesnick Prince & Pappas LLP is representing the Trustee, and the case is jointly administered under Case no. 2:20-bk-10484-NB
