February 22, 2022, Southern District of New York – Upon consideration of the application of the Debtors ABC Carpet Co., Inc., et al., for entry of an order authorizing and approving the employment of ASK LLP (“ASK”) as special counsel to the Debtors nunc pro tunc, Honorable Judge David S. Jones approves the appointment of ASK as the Debtor’s special counsel effective retroactively to the date of October 30, 2021. As stated in the application, the special counsel is employed and retained under section 327(e) of the Bankruptcy Code to render the following services solely:
a. advise and assist the Debtors in all respects regarding their rights, powers, and duties in connection with matters adverse to the 880 Broadway Entities, including, without limitation, the review, analysis, negotiation, and litigation of any claims or actions involving the 880 Broadway Entities in which Greenberg Traurig has a potential conflict of interest; and
b. at the Debtors’ request, advise and assist the Debtors in all respects regarding other matters on behalf of the Debtors in which Greenberg Traurig has a potential conflict of interest.
