Advantage Rent a Car, Delaware Debtor, Fires Off 15 Clawback Cases

May 25, 2022, US Bankruptcy Court for the District of Delaware – CBIZ Accounting, Tax and Advisory of New York, LLC (“CBIZ”), in its capacity as Liquidating Trustee for the unsecured creditors of Advantage Rent A Car, files group adversary proceedings against fifteen (15) Defendants to avoid and recover preferential transfers pursuant to 11 U.S.C. §§ 547 and 550 and to disallow claims pursuant to 11 U.S.C. § 502.

On December 13, 2021, CBIZ was appointed as the Liquidating Trustee under the Joint Chapter 11 Plan of Liquidation of the Debtors in the bankruptcy case of Advantage Holdco, Inc., et al. 

CBIZ affirms that Defendants conducted business with one or more of the Debtors during the preference period. According to the complaint, one or more of the Debtors made transfers to or for the benefit of Defendants for goods and/or services provided by Defendants.

CBIZ requests the Court to avoid and recover from the Defendants transfers made by Advantage Holdco, Inc., et al. to them during the preference period and to disallow any claims of Defendants until such time when Defendants pay to the Liquidating Trustee an amount equal to the aggregate amount of such transfers, plus interest thereon and costs.
