October 4, 2021, Southern District of Texas – Trustee Christopher R. Murray for the bankruptcy estates of Q’Max America, Inc. and Anchor Drilling Fluids U.S.A., L.L.C. files a complaint against Wise Services, Inc. to recover about $1 million for breach of contract, quantum meruit, unjust enrichment, fraudulent misrepresentation, and inducement
The Trustee alleges that at least $1,106,406 is due back to the estate under 11 U.S.C.§ 542(b) because Wise owed this amount to the estate, and the debt due from Wise to the Trustee is property of the estate. Accordingly, the Trustee seeks to turn over the amount improperly invoiced and accepted from the estate under 11 U.S.C. § 542(b) because the Trustee claims that it is a material asset and is of substantial value to the estate.
