JPR Mechanical Trustee Marianne T. O’Toole Seeks $4 Million From Radium2 Capital and Anvil Mechanical As Alleged Preferences

August 13, 2021, Southern District of New York – Radium2 Capital, LLC, a financing company, and Anvil Mechanical Inc., a mechanical engineering company were recently sued by Trustee Marianne T. O’Toole for the bankruptcy estate of Debtor JPR Mechanical for a return of $2,849,805.6 and 1,256,334.00 respectively as alleged preference transfers.

The Trustee brought the adversary proceedings to avoid and recover from the Defendants, all transfers of property that occurred during the ninety (90) day period before the commencement of the Debtor’s bankruptcy case under Sections 547 and 550 of Bankruptcy Code. The Trustee also sought a judicial determination that Defendants did not have a secured position in any property of the Debtor’s Chapter 7 estate and sought to disallow any claims by Defendants against the Debtor’s estate according to section 502(d) of the Bankruptcy Code 

The case is In re JPR Mechanic, Inc., Case No. 19-23480-RDD in the United States Bankruptcy Court for the Southern District of New York. The Trustee is represented by the law firm of LaMonica Herbst & Maniscalco, LLP. Honorable Judge Robert D. Drain is overseeing the Debtor’s bankruptcy case.
