HRB Trustee Brings a Clawback Action Against Procter & Gamble, Seeks Over $800K in Alleged Preferences
December 14, 2021, District of Delaware – Trustee Alan D. Halperin for High Ridge Brands Liquidating Trust sues Procter & Gamble Distributing, LLC (P&G) to avoid and recover alleged preferential transfers worth $850,248.00 under Sections 547 and 548 of the Bankruptcy Code in the bankruptcy case of HRB Winddown, LLC.
Before filing bankruptcy, HRB, as a personal care company, maintained business relationships with various business entities, through which it regularly purchased, sold, received, and delivered goods and services. In its complaint, Halperin requests the Court to grant judgment against the defendant, avoiding the alleged transfers and directing P&G to return them to the Trustee for the benefit of the bankruptcy estate. Halperin also seeks to disallow any claims held or filed by P&G against HRB until the defendant returns the alleged transfers under sections 502(d) and (j) of the Bankruptcy Code.
