Forty-Seven Defendants Face Clawback Actions in Comcar Industries

May 3, 2022, Delaware – Patrick J. O’Malley, the liquidating trustee of debtors Comcar Industries, Inc., et al., filed adversary complaints on May 3, 2022, against forty-seven (47) defendants in the debtors’ jointly administered lead bankruptcy Case No. 20-11120. The cases are filed in the Bankruptcy Court for the District of Delaware. By way of these complaints, the trustee seeks to avoid and recover alleged “preferential” and “fraudulent” transfers. The trustee also seeks to disallow the claims of certain defendants.

The claim amounts in these group filings range between $13,736 to $2,263173. The largest claims by claim amount have been filed against Bankdirect Capital Finance, LLC for $2,263,173), Gallagher Bassett Services, Inc. for $655,929.20 and Demarteleare Trucking for $433,228.

The trustee is represented by the law firm, Fox Rothschild LLP. Bankruptcy Judge Laurie Selber Silverstein is presiding over the bankruptcy case.

On May 17, 2020, each of the debtors commenced a voluntary case under chapter 11 of the Bankruptcy Code. Prior to filing for bankruptcy, the debtors were a transportation company.

The jointly administer case is: In re Comcar Industries, Inc. et al., Bankruptcy Case No. 20-11120(LSS), Bankruptcy Court for the District of Delaware.
