Clawback Actions Initiate in Dura Automotive Systems, LLC, et al

December 14, 2021, District of Delaware – Trustee Jeoffrey L. Burtch for the bankruptcy estates of an automotive components designer and manufacturer, Dura Automotive Systems, LLC, et al. initiates eighty-three (83) clawback actions to avoid and recover alleged preferential transfers of property during the ninety (90) day period before Dura Automotive filed for bankruptcy.

As per the complaints filed in the United States Bankruptcy Court for the District of Delaware, Burtch seeks about $2.1 million from these defendants pursuant to §§ 547 or 548 and 550 of the Bankruptcy Code. Future Electronics (US) LLC, Metco Industries, Inc., Interwire Products – Texas, Inc., Heidtman Steel Products, Inc. are some of the largest creditors in the group who have been sued for the return of transfers.

Honorable Karen B. Owens is presiding over the bankruptcy cases of Dura Automotive. Cozen O’Connor is representing the trustee. The case is In re Dura Automotive Systems, LLC, et al in the United States Bankruptcy Court for the District of Delaware, Case no. 19-12378 (KBO).
