COURSE DESCRIPTION
This is an online Continuing Legal Education course on basic bankruptcy preference and fraudulent conveyance law under Title 11 of the U.S. Code. The faculty, a seasoned bankruptcy claw-back defense attorney, will provide an introduction to preference and fraudulent conveyance claw-back law by discussing the elements of preference and fraudulent transfer claims and general defenses to such claims.
Part 1 - An introduction to bankruptcy preference laws.
  • The purpose of the preference laws.
  • Elements to a preference claim.
  • Contemporaneous exchange defense to a preference claim.
  • Ordinary course of business defense to a preference claim.
  • Industry-standard defense to a preference claim.
  • New value defense to a preference claim.
  • Cutting-edge issues. 
Part 2 - An introduction to fraudulent conveyance laws.
  • The purpose of the fraudulent conveyance laws
  • Elements to fraudulent conveyance laws.
  • “Value” and “reasonably equivalent value” defenses to a fraudulent transfer claim.
  • Good faith” defense to a fraudulent transfer claim.
  • Duty to investigate.
  • Statute of limitation issues
  • Ponzi schemes.
Credits: NY – 2.0 (Areas of Professional Practice)
Duration: 120 minutes excluding break of 15 minutes between Part 1 and Part 2 of the course.
Only registered attendees who attend the full course will receive continuing education credit.
